HIPAA stands for Health Insurance Portability and Accountability Act. This legislation safeguards medical information by providing privacy and security provisions. The purpose of HIPAA is to protect the privacy and security of patient information. As part of the Privacy Rule or Standards for Privacy of Individually Identifiable Health Information, national standards are set to protect information about a person's health.
There is no specific OSHA standard for animal handling procedures. The General Duty Clause of OSHA requires employers to provide employees with a safe and healthy workplace, therefore maintaining procedures for proper safety measures in case of an animal-related injury.
To comply with HIPAA, healthcare providers such as hospitals, health clinics, doctors, nursing homes, pharmacies, dentists, psychologists, chiropractors, and more must adhere to the law. A healthcare provider, health plan, or healthcare clearinghouse that transmits personal health information electronically is subject to HIPAA regulations.
All employees, including doctors, dentists, administrative staff, nurses, and even part-timers, must undergo OSHA training.
Health insurance policyholders, nurses, doctors, receptionists, administrative and part-time staff, and interns must undergo HIPAA training. Employees who hold certain positions, including HIM, network administration, and information technology, may need additional training.
A non-compliant organization violates the 45 CFR Parts 160, 162, and 164 if it fails to comply with HIPAA requirements. HIPAA rules can be violated in hundreds of ways. Here are some common ways to violate this law:
- Unauthorized disclosure of protected health information (PHI)
- Access to protected health information (PHI) without authorization
- Non-termination of PHI access rights
- Inappropriate disposal of PHI
- Non-termination of access rights to PHI when no longer needed
- Theft of medical records
Failing to provide HIPAA training and security awareness training
HIPAA does not require you to be certified, nor is it a requirement. There are also no HIPAA-certified programs. This is a common misconception among healthcare professionals. Under HIPAA, you are only required to follow the guidelines and meet the requirements. HIPAA compliance can be achieved by following the rules and keeping proper documentation readily available.
It's another subject that is open to interpretation. HIPAA does not specify a particular length of training, but it must be long enough to cover the requirements effectively. It won't be possible to complete OSHA or HIPAA training in a few minutes but to ease employees' minds. Training shouldn't take weeks.
